During various testimonies and public statements, DHS Secretary Alejandro Mayorkas has consistently asserted that "the border is not open."
He repeatedly emphasized this point in the face of ongoing debate and criticism regarding border security and immigration policy.

In February 2021, when Mayorkas made the statement, the number of individuals attempting to illegally cross the border was over 100,000, which was the highest for that month since 2006.
In August 2023, encounters along the Southwest Border increased by 14% compared to the previous August, says the House Homeland Security Committee.
Encounters at the Southwest Border increased over 100% in FY2023 compared to FY2019. Nationwide border encounters hit nine million in March 2024, representing a 120% increase compared to February 2021.
Mayorkas himself acknowledged that the system was strained and on pace to encounter more individuals on the Southwest Border than in the last 20 years. He also stated that DHS is working within the constraints of a "broken immigration system" and that the department needs additional resources from Congress
